Procedure for fixing and revising minimum wages (Section 5)
In fixing minimum rates of wages in respect of any scheduled employment for the first time under the Minimum Wages Act, 1948 or in revising minimum rates of wages so fixed, the appropriate Government shall appoint as many committees and sub-committees as it considers necessary to hold inquiries and advise it in respect of fixation or revision of minimum rates of wages as the case may be [Section 5(1)(a) or
By notification in .the, Official Gazette, publish its proposals for the information of persons likely to be affected by the fixation or revision of minimum rates of wages and specify a date, which shall not be less than 2 months from the date of notification, on which the proposals will be taken into consideration.
After considering the advice of the committee or committees so appointed or all representations received by it before the date specified in the notification, the appropriate Government shall, by notification in the Official Gazette, fix or revise the minimum rates of wages in respect of each scheduled employment. Unless the notification otherwise provides, the fixation or revision shall come into force on the expiry of 3 months from the date of its issue. For revision of minimum rates of wages as stated above, the appropriate Government shall consult the Advisory Board also.
